Jammu, March 16:
The Jammu and Kashmir High Court has granted bail to the rape accused after one and a half years. The accused’s wife had filed an FIR against him under rape sections. The accused had filed a bail application on this. There was no opposition from the wife during the hearing.
In the year 2023, the accused Ali Mohammad’s wife had registered a case of rape against him at Police Station Samba. After this, the accused was taken into custody. Ali Mohammad filed a bail application in the court of Principal Sessions Judge Samba. The application of Ali Mohammad was rejected by the District Court.
The accused approached the High Court. The accused also filed another case challenging the FIR against him. In both the petitions, the accused argued that the complainant had lodged the rape FIR with the intention of pressurizing him to get maintenance allowance.
While giving the verdict in the case, the court said that usually bail is not granted in view of such serious allegations. But the complainant has no objection to the petition to cancel the FIR and the application for granting bail. The petitioner is being released on bail. Along with this, the court has banned the accused from contacting the prosecutor or any witness and going out of the state without the permission of the trial court till the settlement of the case.
